What buyers check before they make an offer
Water and sewer service. In Texas, the right to serve an area with water or sewer is held under a Certificate of Convenience and Necessity (CCN). Who holds it, and whether lines are close, changes what a tract can become. You can look up CCN areas on the Public Utility Commission of Texas maps.
Access and frontage. How the land meets a public road, how much frontage it has and whether any access depends on an easement across a neighbor.
Floodplain. Creeks and low ground matter to lenders, builders and insurers. Anyone can check the current flood maps at the FEMA Flood Map Service Center.
City limits and ETJ. Whether a tract sits inside a city, in its extraterritorial jurisdiction (ETJ) or out in the county decides whose rules apply. Since September 1, 2023, Texas law (Senate Bill 2038) has allowed many landowners to petition for release from a city's ETJ.
Ag valuation and rollback taxes. Land taxed on agricultural (1-d-1 open-space) valuation can owe rollback taxes when its use changes: the tax difference for the three years before the change, plus 5 percent interest a year (Texas Tax Code Section 23.55, as amended effective September 1, 2019). Who pays it is something to settle in the contract.
Survey, title and minerals. Boundaries, recorded easements and any mineral reservations all show up in due diligence. Knowing them early avoids surprises at closing.
